Public Offer — Aether VPN Terms of Service
1. General Provisions and Acceptance of the Offer
1.1. This document constitutes a public offer of AETHER VPN (the "Service", "we"), and sets out the terms of use of the Aether VPN service, including the Service page at https://storage.googleapis.com/aether-vpn/start, the Telegram bot @AetherSpaceVPN_bot, applications, and related services (collectively, the "Services").
1.2. Full and unconditional acceptance of this Offer occurs upon any of the following actions: starting to use the Services, activating access via the Telegram bot, or paying for the Services. If you do not agree to these terms, do not use the Service.
1.3. We may amend these terms from time to time. The current version is published on the Service page and/or in the Telegram bot with the date of the latest update. Continued use of the Services after changes are published constitutes acceptance of the new version; if you do not agree with the changes, you must stop using the Services.
2. Age Restrictions and Account
2.1. You must be at least 18 years old to use the Service. Persons under 18 may use the Services only with the consent and under the supervision of a parent or legal guardian who accepts these terms.
2.2. Access to the Services is linked to the user's Telegram account. The user is responsible for keeping access to their account secure and for all actions performed through it. If you suspect unauthorized access, contact support immediately.
3. Description of the Services
3.1. The Service provides virtual private network (VPN) services: encryption of the user's internet traffic and its routing through the Service's servers in various locations, which hides the user's IP address and enhances the privacy and security of the connection.
3.2. The Service maintains a no-logs policy: we do not collect, store, or share information about the user's online activity while connected to the VPN, including visited resources and traffic content. We store only the minimum data required to provide the Services (Telegram account identifier, subscription and payment records).
3.3. Since the Service does not store records of users' online activity, the user bears full and sole responsibility for their actions performed using the Services. The Service strictly opposes any unlawful use of the Services and accepts no liability for such actions by users.
3.4. We may send service and informational messages via the Telegram bot. You may opt out of marketing communications at any time.
3.5. We strive to keep the Services stable but do not guarantee their uninterrupted availability or error-free operation. Access may be temporarily suspended for maintenance and updates.
4. Acceptable Use
4.1. By using the Service, the user agrees to comply with these terms and applicable law and bears full responsibility for their actions.
4.2. It is prohibited to use the Services for:

any unlawful activity;
-
infringement of third-party intellectual property rights;
-
harassment, threats, bullying, or incitement to violence;
-
sending spam or distributing malware, viruses, or other malicious code;
-
attempts to gain unauthorized access to third-party systems, networks, or devices;
-
interfering with the Service's infrastructure or compromising its integrity or performance;
-
impersonating the Service, its staff, or any other person;
-
fraudulent or deceptive schemes;
-
automated data collection (scraping) from the Service's resources;
-
reselling or distributing access to the Services without the Service's written permission, except for sharing access within the limits expressly provided by the selected plan;
-
circumventing security measures, access restrictions, or usage limits;
-
abusing the refund policy, payment mechanisms, trial periods, or promotional offers.
4.3. The Service may investigate violations of this section, suspend or terminate the violator's access without prior notice, and report unlawful activity to the competent authorities.
4.4. If you become aware of a violation of these terms involving the Service, report it to support@aether-vpn.com, describing the violation, the grounds for your report, and your contact details. We will review the report and take appropriate action.
5. Fair Use and Plan Limits
5.1. The scope of permitted use is defined by the selected plan: individual plans are intended for personal use by one user; family plans — for the user and their family members within the number of devices and connections provided by the plan; corporate plans — for an organization's employees under the terms of the relevant plan.
5.2. The Service does not impose fixed traffic limits but may monitor load and take action against usage that exceeds the plan's scope or degrades network performance, including: exceeding the number of simultaneous connections provided by the plan; sustained maximum bandwidth usage; sharing access with persons not covered by the plan; using access for resale purposes.
5.3. In such cases, the Service may suggest switching to a suitable plan, limit connection speed or available locations, and, in the case of gross or repeated violations, suspend or terminate access without a refund.
6. Plans and Payment Terms
6.1. The Services are provided on a paid basis under plans whose scope, duration, and price are indicated in the Telegram bot at the time of purchase. Payment is made on a 100% prepayment basis for the selected period.
6.2. Available payment methods:

bank cards (Visa, Mastercard);
-
cryptocurrency (USDT, etc.);
-
other payment methods available in the Telegram bot at the time of purchase.
6.3. Payments are accepted and processed via third-party payment services. Bank card details are entered on a secure payment page and are not shared with the Service.
6.4. The payment currency is indicated in the Telegram bot at the time of purchase (for example, US dollars (USD) or Georgian lari (GEL)); cryptocurrency payments are made in the respective cryptocurrency. The final charged amount may differ slightly from the listed price due to currency conversion or fees charged by the user's bank.
6.5. The Service does not charge any additional payment fees. The user's bank or payment system may charge its own fees under its own terms; for cryptocurrency payments, the network fee is paid by the user.
6.6. A payment is deemed confirmed at the moment the Service receives the payment service's notification of a successful charge.
6.7. Access to the paid service is granted automatically after payment confirmation — normally within a few minutes and no later than 24 hours after payment. If the service is not activated within this period, contact support.
6.8. Payment confirmation is available in the Telegram bot; an electronic receipt of the payment service (where issued) is sent to the email address provided at checkout. If no confirmation has been received, it can be requested via support.
6.9. In the event of an erroneous, repeated, or double charge, contact support (Telegram: @AetherVpnSupport_bot or email: support@aether-vpn.com), providing the payment date and amount, the payment method, the payment identifier (or the last 4 digits of the card), and your account in the Service. After verification, erroneously charged funds are refunded in full in accordance with Section 8.
6.10. Plan prices are subject to change. A price change does not affect any period already paid for; we will notify active subscribers of price increases in advance.
7. Automatic Subscription Renewal (Auto-Payment)
7.1. The user may voluntarily enable automatic subscription renewal (auto-payment). With auto-payment enabled, the current plan price is charged to the linked payment method on the date the paid period ends.
7.2. Auto-payment can be disabled at any time before the next charge date — in the Telegram bot or via support. Once disabled, no further charges are made; access remains until the end of the period already paid for.
7.3. If the next payment cannot be processed, access to the Services is suspended until payment is received.
7.4. Charges made under auto-payment voluntarily enabled by the user are non-refundable (clause 8.5).
8. Refunds
8.1. Refunds are available throughout the entire paid subscription period, including long-term subscriptions: a request for a refund of the unused part of the period may be submitted at any time before the period ends.
8.2. A full refund of the payment is issued if at least two of the following grounds apply:

no more than 10 calendar days have passed since the payment;
-
the refund request is submitted on the day the subscription was paid for (regardless of its length);
-
the user was unable to use the service because the Service has no solution to the user's problem (regardless of the subscription length or how much time has passed since payment).
8.3. A full refund is also issued if the service was not activated due to the Service's fault, or if a double or erroneous charge occurred (the duplicate or erroneous payment is refunded).
8.4. A partial refund is issued pro rata for the unused paid period if more than 10 calendar days have passed since the payment and technical support was unable to resolve the user's problem, as well as in the event of discontinuation of the Service (Section 15).
8.5. No refund is issued (regardless of how recently the payment was made) if:

the user has decided to switch to another VPN service;
-
the user no longer needs a VPN;
-
the payment was made by accident;
-
the charge was made under auto-payment voluntarily enabled by the user (Section 7);
-
the paid period has been fully used or has expired;
-
access was terminated due to the user's violation of these terms.
Deleting an account does not by itself entitle the user to a refund.
8.6. Refund requests are accepted throughout the entire paid subscription period; for double and erroneous charges — within 30 calendar days from the date of the charge.
8.7. Requests are submitted via support in Telegram (@AetherVpnSupport_bot) or by email at support@aether-vpn.com and must include: the payment date and amount; the payment method; the payment identifier or the last 4 digits of the card; the account in the Service; the reason for the refund. Support may request additional confirmation (a screenshot of the charge, a transaction statement) and may review account usage records before processing the refund.
8.8. Requests are reviewed within 10 business days of receipt of all required information; the user is notified of the outcome via the same channel used to submit the request.
8.9. If approved, the refund is issued within 10 business days exclusively to the payment instrument used for the original payment. Refunds to other accounts, third-party wallets, or by bank transfer are not made. The actual crediting time depends on the issuing bank and payment system and may take up to 30 calendar days. Currency conversion fees and transaction costs are deducted from the refund amount.
8.10. If the payment was made using several methods, the refund is issued to each payment instrument used, in proportion to the amounts paid.
8.11. Payments made with cryptocurrency are non-refundable.
8.12. In the event of a disputed charge or non-provision of a paid service, contact support first — most such situations are resolved with a refund or re-activation of the service. If the issue is not resolved, the user may contact their card-issuing bank; the Service will provide the information required to review the claim upon request.
9. Intellectual Property
9.1. The website, Telegram bot, applications, software, logos, texts, images, and other materials of the Service belong to the Service and its licensors and are protected by intellectual property law. Use of the Services does not transfer to the user any rights to these assets.
9.2. The user is granted a limited, non-exclusive, non-transferable, and revocable license to use the Services for their intended purpose within these terms. Reproducing, modifying, distributing, or selling the Service's materials, or creating derivative works based on them, without the Service's prior written consent is prohibited.
9.3. By sending the Service feedback, ideas, or suggestions for improving the Services, the user agrees that the Service may use and implement them without restriction and without compensation.
10. Disclaimer of Warranties
10.1. The Services are provided "as is" and "as available", without any warranties, express or implied, including warranties of fitness for a particular purpose. The user uses the Services at their own risk.
10.2. The Service does not warrant that the Services will operate uninterrupted and error-free, will be fully protected against failures, will be compatible with any particular device, or will meet the user's individual expectations.
11. Limitation of Liability
11.1. To the maximum extent permitted by applicable law, the Service is not liable for indirect, incidental, or punitive damages, lost profits, loss of data, or loss of business opportunities arising in connection with the use of, or inability to use, the Services.
11.2. The Service's aggregate liability for any claims is limited to the amount paid by the user for the Services during the 12 months preceding the event giving rise to the claim. In jurisdictions that do not allow such limitations, they apply to the maximum extent permitted.
11.3. Interruptions, restrictions, or unavailability of the Services may be directly or indirectly caused by actions of government authorities or internet service providers in the user's country or region. The Service is not liable for such interruptions and restrictions; refunds in such cases are handled in accordance with Section 8.
12. Indemnification
12.1. The user agrees to indemnify the Service for losses, costs, and expenses (including reasonable legal fees) arising from third-party claims caused by the user's violation of these terms, applicable law, or third-party rights.
13. Force Majeure
13.1. The Service is not liable for failure to perform its obligations due to force majeure, including natural disasters, hostilities, acts of terrorism, power outages, actions and restrictions of government authorities (including censorship, blocking, and restriction of internet access), strikes, internet outages, and failures of third-party providers.
14. Suspension and Termination of Access
14.1. The Service may suspend or terminate the user's access to the Services without prior notice in the event of a violation of these terms, or where there are reasonable indications of such a violation. In that case, prepaid funds are not refunded, and the Service may restrict the user's ability to re-register.
14.2. The user may cancel the subscription at any time in the Telegram bot or via support. Cancellation takes effect at the end of the current paid period; refunds are available in the cases provided for in Section 8.
15. Changes to and Discontinuation of the Services
15.1. The Service may change the scope and functionality of the Services, add and remove features, and temporarily suspend individual components. In the event of a material change to, or full discontinuation of, a Service, active subscribers will be notified and will receive a pro-rata refund for the unused portion of the paid period.
15.2. If any provision of these terms is found invalid, the remaining provisions remain in full force and effect. The Service's failure to exercise any right does not constitute a waiver of that right.
16. Final Provisions
16.1. These terms are governed by the law of Georgia. Disputes are resolved through negotiation and, failing agreement, in the competent court of Georgia at the place of the Service's registration (Tbilisi), unless applicable law provides otherwise.
16.2. These terms are drawn up in Russian; this English version is provided for convenience. In the event of any discrepancy, the Russian version prevails.
16.3. The current version was published on 24 July 2026 and takes effect upon publication.
